These Terms of Service ("Terms") govern your use of the website skylightcabin.arch-s.com and any purchases of digital architectural plans from ARCH-S Design Studio OÜ ("ARCH-S", "we", "our", or "us"), a private limited company registered in Estonia. By using our website or purchasing from us, you agree to these Terms.

2. What We Sell

We sell digital architectural plan sets for residential cabins. Each plan set includes architectural drawings, structural plans, MEP (mechanical, electrical, plumbing) schematics, and editable CAD files, delivered as a downloadable ZIP package after successful payment.

2.1 Intended Use

Our plans are sold as reference documents to be reviewed and adapted by a licensed architect, engineer, or contractor in your jurisdiction before construction. They may require modifications to comply with local building codes, zoning laws, climate conditions, and site-specific requirements.

2.2 License Granted

When you purchase a plan set, we grant you a non-exclusive, non-transferable license to use the plans for a single construction project. You may not:

Resell, redistribute, sublicense, or share the plans with third parties not involved in your construction project.
Use the plans to construct more than one dwelling without purchasing additional licenses.
Publish the plans online, in books, or in any form that makes them publicly accessible.
Claim authorship of the plans or remove copyright notices.

3. Orders and Payment

All prices are in US Dollars (USD) unless stated otherwise.
Payment is processed securely by Stripe. We do not store your credit card details.
An order is confirmed only after successful payment. You will receive an order confirmation email with download instructions.
Any applicable VAT, sales tax, or import duties are your responsibility.

4. Delivery

After successful payment, you will receive a download link by email within a few minutes. If you do not receive the email within 1 hour, please check your spam folder and contact us at archs.contact@gmail.com.

Download links remain active for 30 days. If you need an extension, contact us.

5. Refund Policy — Digital Products

Important: Because our plans are digital products delivered instantly after payment, all sales are final and no refunds will be issued once the download has been initiated or the plans have been accessed.

5.1 EU Consumer Right of Withdrawal

Under EU Consumer Rights Directive (2011/83/EU), EU-based consumers normally have a 14-day right of withdrawal on distance contracts. However, this right does not apply to digital content delivered without a tangible medium once the performance has begun with the consumer's prior express consent and acknowledgment that they lose the right of withdrawal (Article 16(m) of the Directive).

By completing your purchase, you expressly consent to the immediate delivery of the digital plans and acknowledge that you lose your right of withdrawal once the download begins.

5.2 Exceptions

We may, at our sole discretion, issue a refund in the following exceptional cases:

Duplicate purchase (accidentally bought the same plan twice).
Technical failure preventing download and not resolvable within 7 days.
Significant defects in the plan set that we cannot correct.

To request a review, email archs.contact@gmail.com with your order number and details within 7 days of purchase.

6. Disclaimer and Limitation of Liability

Our plans are provided "as is" without warranty of any kind, express or implied. ARCH-S Design Studio OÜ is not liable for:

Construction decisions, costs, delays, or errors based on the plans.
Compliance with local building codes, zoning laws, or permitting requirements — these must be verified by a licensed professional in your jurisdiction.
Structural, electrical, or mechanical performance of the built structure.
Any direct, indirect, incidental, or consequential damages arising from the use of the plans.

Our total liability to you is limited to the amount you paid for the plan set.

7. Intellectual Property

All content on this website — including text, images, logos, 3D models, renderings, plans, and drawings — is the intellectual property of ARCH-S Design Studio OÜ or its licensors and is protected by copyright and other intellectual property laws. Unauthorized use is strictly prohibited.

8. User Conduct

You agree not to:

Use our website or plans for any unlawful purpose.
Attempt to gain unauthorized access to our systems.
Interfere with or disrupt the website or servers.
Copy, modify, or distribute our content without permission.

9. Privacy

Your use of our website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the website after changes constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Estonia. Any disputes arising from these Terms or your purchases shall be resolved exclusively in the courts of Estonia, unless mandatory consumer protection laws of your country of residence provide otherwise.
